Never Trust the Insurance Adjustor

One of the reasons I wrote my book, 15 Mistakes That Will Wreck Your Texas Accident Case, was because I constantly see innocent car wreck victims forfeit their legal rights to fair compensation without even realizing it. As a Dallas-Fort Worth personal injury attorney, I’ve seen this happen time and time again.

If you or someone you love has been injured in a traffic collision which was someone else’s fault, you cannot expect their insurance company to treat you fairly. They have absolutely no obligation to do so – and they certainly don’t have motivation to do so. In fact, many insurance adjustors not only get bonuses for swindling innocent victims out of the fair compensation they deserve, they are also assigned targets concerning the percentage of cases they are required to close down within 48 hours of the accident happening. This is a disgusting and incredibly unfair practice – but unless you contact a board certified personal injury lawyer as soon as possible following your accident you could fall victim to these dirty tricks. It happens every day.

Auto accident lawyers have the negative stereotype of being ambulance chasers. In reality, there are very strict laws which prohibit attorneys from initiating unsolicited contact with accident victims within 30 days of their car crash. However, it is worth noting that there are no such rules to prevent the at-fault driver’s insurance company from harassing you. And believe me, they will.

I recently heard about an accident victim on pain medication who received a phone call from the insurance adjustor while she was still in hospital. The adjustor recorded their conversation and got her to agree to accept a measly $250 for her accident. That’s it. That won’t even cover her ambulance ride to the ER. Unfortunately, without knowing it, this innocent victim has waived her right to the fair damages she desperately needs – and deserves.

If you or a loved one has been involved in any kind of accident and suffered an injury, it is critical that you consult with an experienced personal injury or wrongful death lawyer as soon as possible – ideally, before you ever speak to the negligent motorist’s insurance company. You may not need legal representation in your case, but it is always far better to be safe, rather than sorry. Kawasaki Off-Road Vehicle Recalled Due To Risk of Fatal Injuries

As a Dallas-Fort Worth personal injury and wrongful death attorney, I know that ATVs have the potential to cause serious injuries to their occupants in the event of an accident. By far the most common injury suffered in an all-terrain vehicle wreck involved broken, crushed or fractured bones, although injuries frequently experienced in DFW car crash cases are also common. These other injuries include blunt force trauma, spinal cord injuries, traumatic brain injury, and loss of limbs.

Many times, ATV accidents are the result of either design or manufacturing defects which caused the vehicles to malfunction, rendering them faulty and unsafe. One such off-road vehicle was this week recalled by its manufacturer, Kawasaki Motor Corp., USA.

The Teryx Recreational Off-Highway Vehicles were voluntarily recalled after it was learned that the 2012 model of the four-wheel vehicle was incorrectly labeled as having a higher occupant capacity that is actually safe. In actual fact, seating more occupants in the vehicle poses a serious risk of severe injury or even death. Fortunately, there are no reports of any such tragedy prior to the recall announcement.

The affected ATVs retailed for between $10,500 and $12,000 at Kawasaki dealerships throughout Texas since August 2011. Affected consumers are asked to please contact their local Kawasaki dealership for more information.

If you or a member of your family has been injured in an ATV, golf cart or off-road recreational vehicle accident, it is important that you are informed of your legal rights. Regardless of whether the accident was a result of product liability or driver negligence, you may be entitled to compensation. Please call the Anderson Law Firm for a free, no obligation consultation on your case. Call toll free at 800-354-6275 or locally at 817-294-1900. Childhood Traumatic Brain Injury May Increase Risk of ADHD

As a Dallas-Fort Worth personal injury lawyer, I know that children are particularly susceptible to suffer head injuries in car wrecks, falls and other accidents. Younger children in particular are at threat of suffering a traumatic brain injury (TBI) as a result of a vicious dog attack or through intentional abuse (for example, shaken baby syndrome).

Traumatic brain injuries can be extremely serious and have lifelong consequences for the victim. In the worst cases, the victim might suffer severe physical, cognitive and behavioral impairments which could be permanent.

Not all cases of traumatic brain injury are so pronounced, however, in many cases where a child suffered a significant head injury early on in life, they may develop conduct and behavioral problems later on in life. A decades-long study published by researchers in New Zealand found that children with mild TBI (also known as concussion) continued to display sub-clinical emotional and behavioral symptoms as late as 12 months after the injury occurred. Those children whose injuries were significant enough to require hospitalization also had a higher rate of developing attention deficit and hyperactivity disorder (ADHD). In particular, the study noted that the children had decreased attention span, and increased distractibility, hyperactivity and impulsivity.

As any parent of an ADHD-diagnosed child knows, this can have a negative impact on the child’s learning ability in school. According to ADHD experts, this chronic disorder persists into adulthood for approximately 60 percent of all sufferers.

If your child have suffered a head injury or traumatic brain injury, it is important that they receive the very best medical attention in order to reduce the risk of ADHD or other TBI-related symptoms. It is also wise to consult with a board certified child injury attorney as you might be entitled to seek some form of compensation. Although there is generally a two year statute of limitation for Texas accident injury claims, in child injury cases this deadline is extended to the 20th birthday of the child if a settlement has not already been achieved by their parent.

Child Injury Cases

Dog bites. Swimming pool accident. Trampoline injuries. Car wrecks. Bicycle crashes. Daycare negligence. These are just some of the many threats to the safety of children living in Texas. As a Dallas-Fort Worth personal injury lawyer experienced in handling a variety of child injury cases, I know that children could suffer serious injuries from all sorts of different everyday activities. When that happens, however, it is important that the parents ask themselves how it happened; who is at fault?

Depending on the severity of your son or daughter’s injuries, it may be that the accident will have a negative impact on them for the rest of their lives, whether as a physical disability, a psychological fear, or a visible scarring. As such, it is important that you protect their future well-being by speaking with a board certified Fort Worth personal injury attorney who will be able to explain your legal rights and help you understand the full compensation you may be entitled to under state law.

Scooter and Moped Rider’s Rights After an Accident

The global recession and rising fuel costs have had a number of implications for people all over the Dallas-Fort Worth metroplex. One of the most striking trends I’ve witnessed as a personal injury lawyer is the number of people who have traded in their car or pickup truck for a more fuel-efficient and cheaper vehicle such as a motorcycle, scooter or moped.

scooter%20moped%20accident%20lawyer%20fort%20worth%20texas%20dallas%20personal%20injury%20attorney%20wreck%20crash.jpg

However, while these motorists might be saving money, they are also increasing their risk of being involved in a serious accident. Not because scooters are dangerous themselves, or that those who choose to ride them are bad drivers – but because other motorists are dangerously prone to ignore any vehicle which is smaller than their own.

As a DFW attorney, I’ve heard negligent drivers say time and time again that they “just didn’t see” the scooter rider until they crashed into them. There’s a reason for that: they weren’t looking out for them in the first place.

Scooter and moped riders have just as much right to be on Texas roads as any other motorist. Unfortunately, they are rarely given the respect they deserve by other road users. Often this means a horrible collision resulting in devastating injuries which are frequently life-threatening.

It’s important that you understand that you have rights under Texas law. If you were not responsible for causing the wreck, then you are entitled to make a claim for compensation against the negligent driver who was at fault.

For more information, or to discuss your case with an experienced scooter accident attorney, please contact the Anderson Law Firm toll free at 800-354-6275 or call locally at 817-294-1900.

Financial Debt You Might Incur After An Accident

stressed%20couple.jpg

If you've been unlucky enough to have been injured in a Dallas-Fort Worth traffic wreck, it's important that you understand that your chance encounter with a negligent driver could have long term implications which continue long after you complete your medical treatment and your wounds have healed. You may not know this, but unpaid medical bills are the number one reason for bankruptcy in America. Doctors and hospitals are very expensive. Even with really good health insurance, the money you personally owe can be quite substantial. As a Tarrant County personal injury lawyer, I have seen too many of my clients' lives ruined by the bad credit they were stuck with following their accidents, even after their claims have been successfully resolved and the bills paid.

Regardless of whether you were injured in a car wreck, a motorcycle collision or some other accident, chances are high that you're going to incur significant medical expenses over the course of your treatment. Added to that, you're probably going to be out of work for a while, so the loss of income makes the problem even worse. The good news is that in Texas you have the legal right to pursue a claim for compensation against the at-fault driver's insurance company. This will allow you to recover money to pay off your medical debt, replace those lost wages and compensate you for the very real pain and suffering you and your family have endured.

If you or a loved one have been injured in an accident which was not your fault, give me a call for a no fee, no obligation consultation on your personal situation. Call toll free at 800-354-6275 or locally at 817-294-1900.

Dealing With the Insurance Company in Broken Bone Cases

060711%20broken%20bones%201.jpg

In my 20 years as a Dallas-Fort Worth traffic injury lawyer I have helped people injured in all sorts of car wrecks, motorcycle collisions and other accidents. Some of the most catastrophic injuries I’ve seen are broken bone injuries. They can happen to anyone from a kid falling off a climbing frame or a senior citizen slipping in a nursing home. In fracture injury cases it is incredibly important that you have an experienced personal injury attorney holding your hand and dealing with the insurance company on your behalf. You don’t want to do anything which could jeopardize your chances of recovering the maximum possible compensation from the insurance company, because chances are you’ll need it.

If you’re lucky, your broken bones can be fixed with the standard treatment of setting and casting, and waiting for your body to heal itself over time. But in the more serious cases extensive orthopedic surgery is required. Many accident injury victims need long term physical therapy. Some people never fully recover and face lifelong disability as a result of the accident.

You need to be extremely careful in how you deal with the insurance company when pursuing a claim for damages. Usually, the insurance adjustor will try to rush you into settling a claim before you’re had the opportunity to consult with an attorney who can explain your legal rights. Don’t fall for their tricks. Under Texas law you are entitled to seek monetary compensation to help pay for all past and future medical expenses related to your wreck, so you don’t want to settle too soon. I never allow my clients to sign anything until their injuries have stabilized and their doctor is able to say with certainty what their future quality of life will be.

If you or someone you love has been hurt in a Texas accident and suffered any sort of injury, I would like to offer you a free copy of my book 15 Mistakes That Will Wreck Your Texas Accident Case. It’s filled with the most important dos and don’ts to make sure you don’t get taken advantage of by the insurance company. If you live or work in the greater Dallas-Fort Worth metroplex then I offer free consultations to injured individuals and their families. Call me toll free at 800-354-MARK (6275) to set up an appointment.

Spring man dies after fall from ATV at Texas Motor Speedway in Fort Worth, TX

A Spring man died Wednesday from injuries suffered in an all-terrain vehicle accident at Texas Motor Speedway on Nov. 7, the day of the AAA Texas 500.

Eddie Akin, 33, was attending the NASCAR Sprint Cup Series race at Texas Motor Speedway when he fell off an ATV and sustained serious injuries. Akin was taken to John Peter Smith Hospital, where he was treated until Wednesday. He was pronounced dead at 5:36 a.m. Akin was riding an ATV with five others when he fell from the vehicle. No other details were available.

The U.S. Consumer Product Safety Commission documented 555 ATV-related deaths occurred in 2006. The number of fatalities has unfortunately been increasing because of the popularity of all-terrain vehicles. If you are going to driving or riding an ATV, please be careful. My thoughts and prayers go out to Akin’s family and friends.

If you or a family member have been injured or suffered a loss as a result of an accident which was caused by the negligence of another person or product, please Contact Us Online or call our office at 817-294-1900 for a free consultation.
