Scooter and Moped Rider's Rights After an Accident

November 13, 2011

The global recession and rising fuel costs have had a number of implications for people all over the Dallas-Fort Worth metroplex. One of the most striking trends I've witnessed as a personal injury lawyer is the number of people who have traded in their car or pickup truck for a more fuel-efficient and cheaper vehicle such as a motorcycle, scooter or moped.

However, while these motorists might be saving money, they are also increasing their risk of being involved in a serious accident. Not because scooters are dangerous themselves, or that those who choose to ride them are bad drivers – but because other motorists are dangerously prone to ignore any vehicle which is smaller than their own.

As a DFW attorney, I've heard negligent drivers say time and time again that they “just didn't see” the scooter rider until they crashed into them. There's a reason for that: they weren't looking out for them in the first place.

Scooter and moped riders have just as much right to be on Texas roads as any other motorist. Unfortunately, they are rarely given the respect they deserve by other road users. Often this means a horrible collision resulting in devastating injuries which are frequently life-threatening.

It's important that you understand that you have rights under Texas law. If you were not responsible for causing the wreck, then you are entitled to make a claim for compensation against the negligent driver who was at fault.

Scooter and moped riders should know that they have the same rights as every participant in trafic. As long as they meet the same demands like road taxes and insurance they should have the same rights.

Great article ! I wish people would be more considerate of moped and scooter drivers !
