Balcony Collapse Kills Man in Kaufman, Texas

As a North Texas personal injury attorney I am always upset to learn of unnecessary deaths as a result of accidents which could so easily have been prevented. One such sad incident occurred in Kaufman, Texas on Saturday. Jose Martinez-Hernandez (37) was enjoying his apartment’s balcony when it collapsed beneath him. Investigators say that Mr. Martinez-Hernandez fell almost 12 feet and died at the scene. An engineer is now going to examine all balconies at the complex.

This tragedy is a classic case of a dangerous property condition. Mr. Martinez-Hernandez paid rent at his apartment and shouldn’t have to worry about his own safety while enjoying the outside portion of his own home. The apartment manager is responsible for ensuring that all units are free of any construction defects and that they are regularly maintained to ensure safety for residents. While my thoughts are certainly with Mr. Martinez-Hernandez’s family at this awful time, I certainly hope the news of this accident prompts other apartments across Dallas-Fort Worth to review their balconies and stairways to make sure no one else suffers a similar tragedy.
