Convicted Hurst Intoxicated Man Kills Hard Working Carrolton Man

Updates for Hurst Wrong-Way/Intoxicated Crash Kills Innocent Carrolton Man

Intoxication manslaughter charges are expected to be filed against a Crowley man in the death of a Carrolton man. The Crowley man was driving a minivan the wrong way on Airport Freeway on October 16, when it crashed into a car. Blood test results completed a couple days ago showed that the driver was above the .08 blood alcohol level. In Texas it is a class C misdemeanor to have an alcohol level above .08 and one can be charged with a felony when a fatal accident with alcohol occurs. The police department declines to say what his BAC was. The van driver, Eric Supe, 22 was initiall arrested at the scene and charged with intoxication assault as Ricardo Magallon, 32, of Carrolton, was being treated at Texas Health Harris Methodist Hospital Fort Worth. Magallon, a husband of two children, died a few hours after the crash. The collision occurred shortly after 5 a.m. in the 400 block of Airport Freeway, near Hurstview Drive.

This horrific story is not one I like to read, but hopefully someone that reads it will learn something. About 61 percent of drivers who cause a car accident were under the influence of drugs or alcohol, so it is no surprise to me that Eric Supe was intoxicated when the accident happened. My thoughts and prayers go out to the Magallon family and friends through this difficult time.

Attention: Hyland's Teething Tablets Recalled Throughout Texas

Hyland's Teething Tablets have been recalled by the company after reports by the FDA suggested the presence of some potentially toxic substance. This substance has serious adverse effects such as seizure, difficulty breathing, and muscle weakness. The FDA has therefore asked the consumers to discard this tablet which is sold as a homeopathic remedy for teething pain in babies. Belladonna toxicity is being considered to be behind the whole problem causing some very severe harm at high doses.

Several children taking the tablets were found to be experiencing symptoms which were very similar to belladonna toxicity. Also, since the containers do not have the child-resistant caps, children were found to be consuming more than what was recommended.

The agency warned the parents to take immediate action if their child experienced suspicious symptoms after using the tablets. Some of the symptoms are excessive sleepiness, muscle weakness, skin flushing, constipation, difficulty urinating, agitation, seizures, difficulty breathing and lethargy. The reports said that these tablets too contained inconsistent amounts of the ingredient. The FDA further said that it was "not aware of any proven clinical benefit offered by the product”.

Hyland’s Teething Tablets have been used for more than 85 years they are a pretty reputable company. In 2009 there were 1,752 recalls in the United States which averages out to 67 recalls per week. Hopefully every parent who buys this for their kids finds out about the warning to prevent kids being sick.

Importance of Wearing a Seat Belt Around Fort Worth

The other day I was driving home from taking my dog Andie to the vet for a checkup. While Andie was in the back of my SUV she was roaming around and being a dog in the back seat. Suddenly traffic came to a sudden stop on I35 and I had to press down on the brakes. When I pushed on the brakes Andie lost balance and stumbled around. This got me thinking about the important role that seat belts play.

Seat belt safety is not just for the safety of the person wearing the belt, but for all the occupants in the vehicle. In Fort Worth, a person commits an offense if they are not wearing a seat belt while in a vehicle. Additionally, kids must be in a child passenger seat if they are younger than eight and smaller than four feet nine inches.

Whether it is driving down the street or driving across town, people need to get in the habit of wearing their seatbelt. Buckling up is the single most effective thing you can do to protect yourself. In 2008, seat belts saved more than 13,000 lives nationwide. Some people think that because their car is equipped with airbags then that will keep them safe. However, this is not the case. Airbags are actually designed to work with the seat belts, not replace them.

There are certain ways to ensure that you buckle up correctly. In order to buckle up correctly one must place the shoulder belt across the middle of the chest and away from the neck. Many times kids don’t want to wear the seat belt across their shoulder because it is uncomfortable or they want to put the shoulder belt behind their back, but that is not safe. The seat belt should be adjusted across the hips and below your stomach.

Although one can think seat belts are pointless, there are reasons why it is the law to wear it. If you have any questions regarding a car accident in Fort Worth, please contact Car Accident Lawyer Mark A. Anderson for a free consultation.

Dallas & Fort Worth Is Number Two on The Top Ten Road Rage Cities

Just about everyday when driving home from work I see someone that is tailgating, a driver cuting other drivers off, or drivers flipping the bird to another vehicle. Each year, Conneticut-based automible club AutoVantage surveys 2,500 drivers nationwide to learn where the hotbeds of road rage are. The study shows that New York is the road-rage capital of the world, followed by Dallas/Fort Worth. There are many factors that go into the making of road rage: distracted drivers, speeding, people who are angry/stressed, running red lights, people who are in a hurry, slow traffic, and semi-trucks who get in the way.

Perhaps the biggest epidemic of why DFW is ranked number two is because there are no laws on distracted driving. Eight states have already made it a law to prohibit all drivers from using handheld cell phones whil driving. 30 states have made it a law prohibiting text messaging while driving. Texas currently does not have any sort of law against cell phones except in select school zones.

How Much Property Must Your Car Have To Pursue A Personal Injury Claim?

Car wrecks happen every day here in Fort Worth and we receive a lot of calls from people who have been injured in those accidents. One of the first things we look at in deciding if we can help is the actual damage received by the cars involved in the accident. The amount of property damage your car received if you were in an automobile accident matters. If your car only has very minor damage, it is unlikely that you are going to be able to convince the responsible party's car insurance company (or ultimately a jury) that your injuries are directly related to the motor vehicle accident. As a personal injury attorney, I look at both the physical (visible) damage to the vehicle as well as the repair estimate prepared by a body shop. Depending on where the actual damage is located on the car, the amount of damage required varies.

Basically, it needs to be of sufficient damage, both physically and monetarily, for an ordinary person to believe that the wreck could produce an injury. It is not enough that the car is barely dented or just scratched. Click here for more information on what kind of damage is necessary to support a Texas personal injury claim.

Raising Awarness of Distracted Driving In Texas

It seems that everyone knows distracted driving is a subject that is becoming more and more talked about. Every day we read an article in the paper about a life lost because of a careless driver. I have a feeling that distracted driving is going to play out like drunk driving. It will be hard to monitor and patrol by police officers, but the best way to get and keep the numbers of accidents down is by raising awareness, as well as deciding to make healthy choices. That is why I have put together a program called Teens Against Distracted Driving (TADD) this program will have a direct impact and will hopefully save many lives.

I am proud of high-school students who are just starting to drive that are signing a pledge to not text or use their cell phone while driving. It can be very tempting at times, but the best habit to get into is to never do it at all. Colleyville Heritage High School is one of the six schools participating and here is a picture I took at their school. They are doing a great job of promoting safe driving at their school. I encourage not just the high school students, but everyone who owns any electronic device and a vehicle to not combine the two.

The Anderson Law Firm has offices in Fort Worth and Dallas and would be more than willing to give you a free consultation. If you have any questions feel free to go to our website, or give us a call.

Tarrant County Teens Against Distracted Driving: Raising Awarness

Teens Against Distracted Driving (TADD) is an awareness program started by the Anderson Law Firm to alert high school students about the dangers of not having full attention when they get behind the wheel of a vehicle. Here’s how our latest TADD project works: I supplied six different high schools in Tarrant County with pledge cards to sign an agreement to not text while driving. Once the student signs the agreement in return receives a flashy orange bracelets that reads: I PLDG 2 NT TXT N DRV. The six schools that are participating include: Haltom High School, Central High School, Colleyville Heritage High School, Richland High School, South Hills High School, and Northside High School. The school that receives the highest percentage of students to sign the petitions will receive a $500 donation from me to use at their discretion.

The main reason I am raising awareness about distracted driving, is because drivers are becoming less and less aware of what other cars are doing and more and more worried about checking to see who wrote on their facebook wall. Our culture no longer has to wait and get home to get the phone number to Dominos pizza, instead we can just simply google it on our phone while entering the address in our GPS and still manage to drive 70 MPH. Don’t get me wrong, I love all these new gadgets that continue to evolve, but I absolutely hate how many lives are being ruined. I have a true passion to educate people and want to help in any way I can. I hope every student that signs a pledge and wears the bracelet thinks about the true meaning of distracted driving.

Fort Worth Teen Dies In ATV Crash

Fort Worth teenager Brooke Franklin, 14, died from a head injury he suffered after being thrown from a friend's All-Terrain Vehicle (ATV). The accident happened at The Hill Apartments complex in the 3100 Block of Normandale Street in west Fort Worth. Franklin lived at the complex while his mother is a managed the complex. Some youngsters including Kainen Hadnot, Franklin's best friend, say Franklin was riding on the vehicle in the parking lot going about 20 miles per hour when he ran into a curb. The 4 wheeler hit a curb and sent him flying into a wall. Franklin, an eighth grader at Leonard Middle School, died at the scene.

A young girl knocked on a door and got someone to perform CPR while another person was trying to apply pressure to Franklin's head, however his injuries were too severe. Joseph Sport, Franklin's step-father, says the 14-year old was mature for his age and was not acting recklessly. His step-father told him not to ride the 4-wheeler. Franklin told his step-father he was putting the ATV up before the accident happened.

ATV’s are a raising epidemic with children and adults. They are a blast to ride, but are very dangerous no matter the age of the driver. In 2006, there were 555 deaths and over 146,000 hospital injuries caused by 4-wheelers. The number continues to rise as does the number of ATV’s sold annually. The most important thing to remember is to always wear a helmet, no matter where or when you are on an ATV.

Police Officer Injured In Arlington: Another Drunken Driver

A man suspected of driving drunk crashed into a police car about 5 a.m. this morning in east Arlington, injuring a police officer. The officer and the suspect both were taken to Medical Center of Arlington from the scene of the wreck near intersection 360 and Pioneer Parkway. The police officer had a green arrow to turn, but his car was struck by a white car that was speeding westbound on Pioneer Parkway into the intersection. The officer was treated at the hospital and released two hours later. At 7:30 a.m. the driver of the white car was still in the hospital. Alcohol was found in his vehicle and additional information leads police investigators to believe that he was intoxicated at the time of the wreck. Once he has been released from the hospital, he is expected to be transported to the Arlington City Jail.

There is clearly a problem with driving under the influence in Tarrant County. Over 1,400 deaths are caused by drunk drivers in Texas every year. I am glad the police officer was lucky enough to see another day. Years ago, I represented the family of an Arlington Police Officer who was killed in the line of duty by a drunk driver. It was a horrible case. I am glad the injuries sustained by this officer appear to be minor.
